永見凪（@nagi_1o_o1）制作のLive2Dモデルをご検討いただきありがとうございます。
本規約は「販売中のレディメイドモデル」および「オーダーメイド制作」の両方に適用されます。
📋権利と著作権について
モデルの構成によって権利関係が異なります。ご購入前に必ずご確認ください。
1. 永見が原画から作成しているレディメイドモデルの場合

著作権：購入者に譲渡いたします

著作者人格権：原則行使いたしません

制作実績公開：当方のポートフォリオ等で公開いたします。

修正対応：原則有償（不具合修正は無償）
2. nizima販売イラスト等を利用した二次販売モデルの場合

モデリングの著作権：購入者に譲渡いたします。

イラスト（原画）の著作権： 原画制作者様に帰属します。譲渡の有無や範囲は、原画制作者様の規約に準じます。

著作者人格権：原則行使いたしません

制作実績公開：当方のポートフォリオ等で公開いたします。

修正対応：原則有償（不具合修正は無償）
3. オーダーメイド制作の場合

モデリングの著作権：購入者に譲渡いたします

イラスト（原画）の著作権： 原画制作者様に帰属します。

著作権譲渡の有無や範囲については、原画制作者様の規約に準じます。

著作者人格権：原則行使いたしません

制作実績公開：公開時期の調整が可能です。非公開を希望される場合は別途ご相談ください。

修正対応：制作工程内での修正は3回まで無償（4回目以降は有償）。不具合修正は無償。
【著作者人格権について】
原則行使いたしませんが、著作者の名誉を著しく損なう利用（犯罪行為、差別的表現、過度な公序良俗違反等）がある場合に限り、その行使を妨げないものとします。
✅ 許可されていること（利用許諾範囲）
個人・法人、商用・非商用を問わず、以下の活動に制限なくご利用いただけます。
※他者原画モデルの場合は、原画制作者様の許可範囲内に限ります。

多目的利用： VTuber活動、動画作品、SNS発信、ゲーム制作等。

収益化： 広告収入、投げ銭、グッズ売上等はすべて活動者様ご本人のものとします。

外部依頼・アップデート：

他のクリエイター様へのキービジュアル、新衣装等の依頼。

同梱のパーツ分けPSDを用いた、他モデラー様へのアップデート依頼。

クレジット表記： SNSのプロフィールや動画概要欄等への記載をお願いいたします（例：モデル制作 永見凪 @nagi_1o_o1）。
❌ 禁止事項（全プラン共通）
以下の行為は固くお断りいたします。

自作発言・二次配布： データの転売、共有、再配布（二次販売）行為。

権利の転売： 譲渡した著作権をさらに第三者へ譲渡・販売する行為。

不適切利用： 公序良俗に反する行為、宗教・政治等の特定思想の普及を目的とした活動。

キャラクター性を著しく貶める表現： 悪意のある編集や演出。
-
AI学習の禁止： 本モデルのデータ、および画像素材をあらゆる機械学習（AI学習・画像生成等）に使用すること。
🛠 サポート・修正について

不具合対応： モデルの動作不備については、取引完了後も随時無償で修正対応いたします。

カスタマイズ（有償）： パーツの色変更や差分の追加などは、別途お見積りにて承ります。
⚠️ 免責および注意事項

自己責任原則： 本モデルの使用に起因するいかなるトラブルにつきましても、制作者は一切の責任を負いかねます。

動作環境： 撮影環境やトラッキングソフトの設定により動作が異なる場合があります。環境起因の動作不良については対応いたしかねます。

返品返金： デジタルデータの性質上、返品・返金には対応いたしかねます。

規約の改定について： 活動状況やサービスの変更に伴い、本規約を改定する場合がございます。重要な変更がある場合には、事前にSNS等で告知を行うよう努めます。常に最新の規約をご確認の上、ご利用ください。

These terms apply to both "Ready-made models for sale" and "Custom-made (Order-made) models."
📋 Rights and Copyright
The ownership of rights varies depending on the model's configuration. Please check the details before purchasing.
1. Ready-made models (Original illustrations by Nagi Eimi)
Copyright: Transferred to the purchaser.
Moral Rights: In principle, these will not be exercised.
Portfolio Use: The creator reserves the right to showcase the work in their portfolio at any time.
Modifications: Paid service (Technical bug fixes are free of charge).
2. Secondary models using illustrations from nizima etc.
Modeling Copyright: Transferred to the purchaser.
Illustration (Original Art) Copyright: Belongs to the original illustrator. The scope of transfer follows the original illustrator's terms of use.
Moral Rights: In principle, these will not be exercised.
Portfolio Use: The creator reserves the right to showcase the work in their portfolio at any time.
Modifications: Paid service (Technical bug fixes are free of charge).
3. Custom-made (Order-made) models
Modeling Copyright: Transferred to the purchaser.
Illustration (Original Art) Copyright: Belongs to the original illustrator. The scope of transfer follows the original illustrator's terms of use.
Moral Rights: In principle, these will not be exercised.
Portfolio Use: Timing of publication can be negotiated. Please consult us if you wish for the work to remain private.
Modifications: Up to 3 revisions during the production process are free. From the 4th revision onwards, a fee will be charged (Technical bug fixes are free of charge).
Regarding Moral Rights:
In principle, the creator will not exercise their moral rights. However, the creator reserves the right to exercise them in cases of use that significantly damage the creator's reputation (e.g., criminal acts, discriminatory expressions, or extreme violations of public order and morals).
✅ Permitted Uses
Regardless of individual or corporate status, or whether for commercial or non-commercial use, the following activities are permitted without restriction.
Note: For models based on another person's original art, this is limited to the range permitted by the original illustrator.
Multi-purpose Use: VTuber activities, video works, SNS posts, game production, etc.
Monetization: All revenue from advertising, donations (Super Chats), merchandise sales, etc., belongs solely to the user.
External Commissions & Updates: * Commissioning other creators for key visuals or new outfits.
Requesting updates from other modelers using the included layered PSD file.
Credit Notation: Please credit the creator in your SNS profile or video description. (e.g., Model by Nagi Eimi @nagi_1o_o1).
❌ Prohibited Actions (Applicable to all plans)
The following actions are strictly prohibited:
False Authorship & Redistribution: Claiming to be the creator, reselling the data, sharing, or redistributing the data.
Resale of Rights: Selling or transferring the assigned copyrights to a third party.
Inappropriate Use: Activities that violate public order and morals, or activities aimed at promoting specific religious or political ideologies.
Damage to Character Integrity: Malicious editing or presentation that disparages the character.
Prohibition of AI Learning: Using the model's data or image materials for any form of machine learning (AI training, image generation, etc.).
🛠 Support and Revisions
Bug Fixes: Any operational defects in the model will be fixed free of charge even after the transaction is completed.
Customization (Paid): Changes to part colors or addition of expressions/toggles will be quoted separately.
⚠️ Disclaimer and Notes
User Responsibility: The creator shall not be held liable for any trouble or loss arising from the use of this model.
Operating Environment: Movement may vary depending on the recording environment or tracking software settings. We cannot provide support for malfunctions caused by the user's specific environment.
Refunds: Due to the nature of digital data, we do not accept returns or provide refunds.
Revision of Terms: These terms may be revised or updated based on changes in activity or services. In the event of significant changes, we will strive to notify you in advance via SNS. Please always ensure you are following the latest version of these terms.
